TERMS AND CONDITIONS

This section deals with Ordering, Payment, Dispatch, Delivery and Shipping to UK and Non-UK Customers

1. ORDERING

  1. There is a minimum order of £3.00
  2. All purchases are covered under the Consumer Contract Regulations, which gives the Buyer the right to cancel the purchase within fourteen (14) calendar days after the item it received.
  3. Our website will not normally allow you to order items which are out of stock, however, if a situation arises where an items is subsequently found to be out of stock or fails to meet our quality standards, you will always be contacted and given the option to cancel, substitute or otherwise adjust the Order to suit you.
  4. In order to protect you and your personal details from fraudsters, all items will be delivered to the Billing Address. Please do not ask us to send to an alternative address - no exceptions, not even Christmas. In PayPal you are able to change the address in your account. For Credit Cards, please check your account to see if you can use alternative addresses.
  5. Under the terms of Consumer Contract Regulations, the buyer has the right to cancel the order within 14 days. However, repeated hoax buyers (where items are ordered, paid for and then refunds are requested within a few hours of order), will not be tolerated. On the third occasion, a fee of £5 will be retained by Tribes and Vibes from the refund to compensate us for time spent on emails, administration and paperwork.

2. PAYMENT ~ GENERAL

  1. All Prices are displayed in UK Pounds Sterling (GBP)
  2. All Payments are made in UK pounds Sterling (GBP)
  3. Conversion for payment is performed by the customer’s card holding company or PayPal.
  4. Currency Conversion - as an estimated guide, you can convert to your currency via the currency converter.

2a. PAYMENT: UK BUYERS

  1. Payment must be made online via PAYPAL / Credit Cards. An account is not required.
  2. TRIBES AND VIBES will NOT accept personal cheques or Postal Orders.
  3. PAYPAL: The Buyer does not need to have a PayPal account, it will accept all major credit and debit cards. The Buyer inputs their credit card details into the PayPal system which has its own security systems guarding it. WE DO NOT SEE THE BUYERS’S CARD DETAILS. We are only provided with a Transaction record number, and the same number is provided to the Buyer as a record of the purchase.
  4. As part of our fraud prevention strategy, we will only send orders to the cardholders address, or the address on the PayPal buyer details. Please do not ask us to ship to a different address.
  5. We are not VAT registered, therefore prices shown do not include VAT, nor is VAT added at the checkout.

2b. PAYMENT: NON-UK BUYERS (Ireland, Europe, USA, Canada, Australia, New Zealand)

  1. Payment must be by PAYPAL or Credit Cards. An account is not required.
  2. TRIBES AND VIBES will not accept International Money Orders.
  3. PAYPAL: The Buyer does not need to have a PayPal account, it will accept all major credit and debit cards. The Buyer inputs their credit card details into the PayPal system which has its own security systems guarding it. WE DO NOT SEE THE CUSTOMER’S CARD DETAILS. We are only provided with a Transaction record number, and the same number is provided to the Customer as a record of the purchase.
  4. As part of our fraud prevention strategy, we will only send international orders to the cardholders address, or the address on the PayPal buyer details. Please do not ask us to ship to a different address.
  5. TRIBES AND VIBES does not accept liability for non-UK customers assuming that prices are shown in any currency other than GB Pounds Sterling. A link to a currency converter is available throughout the site, so that the Buyer can estimate the value of their order to their own currency at the time. Your own bank/credit card company will convert the value of your order from GB Pounds Sterling (as shown in your order confirmation email) to your own currency at the time the transaction is processed. TRIBES AND VIBES has no control over the currency conversion rate or administrative charges that the Buyer’s bank/credit card company uses. Non-UK/EU Customers should read the Customs & Excise Notice (Section 7 below) prior to placing an order.
  6. We are not VAT registered, therefore prices shown do not include VAT, nor is VAT added at the checkout.

3. DISPATCH & DELIVERY ~ GENERAL

  1. Items are usually dispatched within 1 working days of receiving cleared payment Monday to Friday. We do not ship at Weekends or during UK Bank/Public Holidays.
  2. Items ordered by 1:00pm are dispatched on the same day, Monday to Friday, or by the next working day during the busy Christmas weeks in December.
  3. ROYAL MAIL NEXT DAY DELIVERY. This service is only available Monday to Friday. You must pay for your order by 1:00pm. TRIBES AND VIBES cannot take responsibility if the Royal Mail fails to deliver by the times advertised. Please visit the Royal Mail site at www.royalmail.com for more information.
  4. All shipping times are approximate since we have no control over the package once it has left us. Please note also, that delivery times are only estimates and are measured from when we ship, not from when the Order is placed.
  5. If there are any access restrictions (eg flats, halls of residence etc.) which may prevent the shipping agent making the delivery, the Buyer is solely responsible for ensuring the necessary arrangements have been made to give unimpeded access for the delivery and for the package to be signed for where appropriate.
  6. We regret that we are unable to mark parcels with 'leave in porch' (or similar instruction) due to possible theft.
  7. All orders are dispatched by TRIBES AND VIBES - we do not use third parties to send orders out on our behalf. TRIBES AND VIBES are not responsible for delays in delivery once your parcel has passed into the hands of the Royal Mail (including but not exclusively, natural disasters, industrial disputes, weather conditions, civil disputes, Acts of God or war).
  8. NON-DELIVERY OF PACKAGE: where Royal Mail (or equivalent Postal service) attempts to make delivery to the Buyer, and delivery cannot be made, the package is usually held at the local Postal depot for Customer collection, or returned to TRIBES AND VIBES if the address is incomplete. If the package is returned to TRIBES AND VIBES for whatever reason, TRIBES AND VIBES will issue a refund (minus the cost of Shipping, where applicable, and 10% of the order to cover time & packing expenses), to the Customer’s original method of payment. If the Customer wishes the item to be re-sent, the Customer will be invoiced for the cost of re-Shipping.
  9. ORDER NOT RECEIVED: if your order has not been received within our suggested time limits, please contact us as soon as you suspect that your order has gone missing. The Royal Mail will not consider that an item is lost or delayed until 15 working days have elapsed from the date of posting, and we are bound by the same rules. When 15 working days have elapsed, if your order has still not been delivered, we will either refund your payment or send a replacement to you. Items that are reported as missing after 28 days of the date of dispatch will not be considered eligible for refund or replacement.

4. SHIPPING WITHIN THE UK

  1. Royal Mail Standard 1st and 2nd Class or Royal Mail Signed-For are both FREE to UK Buyers and will be stated on each product description. Where the order has a mixture of 1st and 2nd class free postage, the order will be upgraded to 1st class if the number of items is greatest.
  2. Where Signed-For, Special Delivery 09:00am, Special Delivery Next Day 1:00pm and Special Delivery Saturday services are not stated as being included as the standard delivery for an item or the entire order, the Buyer will have the opportunity to upgrade at Checkout and pay for additional costs, as above.
  3. Orders must be paid for by 1:00pm for Special Delivery Next Day and Special Delivery 09:00am. This service is only available Monday to Friday. If you are ordering on a Friday and require the item for Saturday delivery, you will need to take one of the Saturday Guarantee options.
  4. Delivery of Royal Mail First Class post is usually within 1-3 working days. It can take longer and can be affected by the remoteness of your location, weather problems, Royal Mail delays etc. Royal Mail deliveries can take up to 7 working days in the UK. If you think the item is lost in the post, please contact us as soon as you have any suspicions that this might be the case, so that we can solve the problem amicably. If your order has not been received within our suggested time limits, please contact us as soon as you suspect that your order has gone missing. The Royal Mail will not consider that an item is lost or delayed until 15 working days have elapsed from the date of posting, and we are bound by the same rules. When 15 working days have elapsed, if your order has still not been delivered, we will either refund your payment or send a replacement to you. Items that are reported as missing after 28 days from the date of dispatch will not be considered eligible for refund or replacement.
  5. We always obtain proof of posting.

5. SHIPPING OUTSIDE OF THE UK (Ireland, Europe, USA, Canada, Australia, New Zealand)

We use the following services: Royal Mail International Tracked, Royal Mail International Signed, or Royal Mail International Tracked & Signed(Tribes and Vibes will use the appropriate service)

  1. On the Custom Declaration form CN22, we will not describe item(s) value(s) as being below the retail value, or mark packages as "Gifts" ~ international government regulations prohibit such behaviour.
  2. All items are sent either by Royal Mail International Tracked or Royal Mail International Tracked & Signed. You only need to pay for this service ONCE at a cost of £8.10 GBP (Europe & Ireland), £8.75 GBP (outside Europe, North America) or £8.95 (Australia, New Zealand). Every additional item that you purchase will usually add either £0.15p (Europe) or £0.25p (outside Europe) per item to your Shipping charges (see table above).
  3. Delivery to Ireland & Europe usually takes 5-10 working days from our dispatch date. Delivery to USA, Canada, New Zealand & Australia can take between 10-21 working days from our dispatch date. Some items may take longer and can be delayed due to seasonal variations, Postal Service delays, Airlines and weather problems etc.
  4. ORDER NOT RECEIVED: if your order has not been received within our suggested time limits, please contact us as soon as you suspect that your order has gone missing. The Royal Mail will not consider that an item is lost or delayed until 20 working days (for European destinations, and 25 working days for the rest of the world) have elapsed from the date of posting, and we are bound by the same rules. When 20 or 25 working days have elapsed, if your order has still not been delivered, we will either refund your payment or send a replacement to you. Items that are reported as missing after 50 days from the date of dispatch will not be considered eligible for refund or replacement.
  5. TRIBES AND VIBES cannot be held responsible for any delays in delivery once your parcel has passed into the hands of the Royal Mail (including but not exclusively, natural disasters, industrial disputes, weather conditions, civil disputes, Acts of God or war).

This section deals with Customs & Excise, Returns, Refunds, Prices, Product Descriptions, Limit of Liability.

6. ORDERING & CANCELLATION

  1. All purchases are covered under the Consumer Contract Regulations, which gives the Customer the right to cancel the purchase within fourteen (14) calendar days after the order was placed. Please contact us here.
  2. Our website will not normally allow you to order items which are out of stock, however, if a situation arises where an items is subsequently found to be out of stock or fails to meet our quality standards, you will always be contacted and given the option to cancel, substitute or otherwise adjust the Order to suit you.

7. CUSTOMS & EXCISE NOTICE

IMPORT DUTIES, TAXES AND CHARGES are NOT INCLUDED in the item price or Shipping charges.  These charges are the Customer’s responsibility.
Before placing an order, please check with your country's Customs & Excise Department to determine the legal requirements for the importation of goods into your country, as well as any cost implication. The Customer should also be aware of possible Customs controls, such as:

  • duty and Goods & Services Taxes (GST) may be payable;
  • it may be a prohibited import and require a permit before it is allowed into the country; or
  • it may be a prohibited import and not allowed into the country under any circumstance and will be seized by Customs for destruction.

Delivery to non-UK/European Union countries may result in import duties being required to be paid on receipt of the goods, or in the case of prohibited items, seizure of goods. You agree under our terms and conditions of sale to be liable for these duties and in the case of seizure to accept full legal responsibility and to acknowledge that a refund under either of these circumstances will not be made.

8. RETURNS & REFUNDS

  1. Under the Consumer Contract Regulations it is your right to cancel an order (and return goods if they have been delivered to you) within 14 calendar days of ordering, this is known as the "cooling off" period. You must return the goods within the next 14 days of notifiying us of your intention to return them. If the item proves to be faulty after this time, please contact TRIBES AND VIBES in the first instance.
  2. Goods can only be returned by prior arrangement with us. Please contact us in the first instance to let us know that there is a problem with your order, and we will give you instructions for returning the item(s). TRIBES AND VIBES will not accept responsibility for goods which are returned without prior arrangement, and are subsequently lost in transit.
  3. NON-DAMAGED ITEMS: it is the Customer’s responsibility to notify us in the first instance and return the item within 14 days (via Royal Mail Signed-For Delivery or equivalent Non-UK trackable service) and we will then refund the full amount, providing the item is in the same condition, as when it was despatched by us, ie. unworn and with the immediate cellophane packaging / plastic packaging / lip cards in tact. Shipping costs will be the responsibility of the Customer if items are not damaged.
  4. DAMAGED ITEMS: it is the Customer’s responsibility to notify us in the first instance and return the item within 30 days (via Royal Mail Signed-For Delivery or equivalent Non-UK trackable service) and we will then refund the full amount of the cost of the item. In addition TRIBES AND VIBES will refund the Buyer's Shipping costs of returning the faulty item.
  5. EARRINGS are packaged in a plastic sleeve so that they can be inspected without opening the original packaging. For reasons of Hygiene, we can only accept Earring Returns if the original plastic packaging remains unopened (box or foam wrapping excluded) and are returned in that condition. We will also accept Earring Returns if they are damaged on arrival.
  6. Any unopened and unused item can be returned within 14 days for a full refund. Returned items will be checked and if found to be used no refund will be given and a charge to re-post will be made.
  7. The Buyer becomes the owner of the goods when they accept delivery, and will remain the owner of the goods until they are returned to TRIBES AND VIBES and a refund is issued. It is the Buyers responsibility to provide a secure and well-packaged return. Refunds cannot be given if the goods are not received at TRIBES AND VIBES. It is therefore in your own interest to return goods via Royal Mail's Signed-For Service (within the UK), or NON-UK equivalent, so that the Royal mail (or equivalent non-UK postal company) can assist you with finding the pacakge if it goes missing in the post.  Royal Mail's Signed-For service will add £1.10 to the standard price of a 1st or 2nd class "large letter" stamp.

9. PRICES

  1. We are not VAT registered, therefore prices shown do not include VAT, nor is VAT added at the checkout.
  2. TRIBES AND VIBES reserves the right to increase the price of an item at any time without prior notice.

10. PRODUCT DESCRIPTIONS

  1. "Unique Items": these are one-off items, and you will receive the item that is featured. These items usually have a unique number in the title of the item, for example, "Fantastic Pendant, #1".
  2. "Example of Stock". These are stock items and the photos are examples of the stock that we hold. You will receive an item from the stock.  Each Crystal Pendant / Pendulum / Tumblestone is made from polished, natural and unique Crystal ~ no two crystals are the same ~ the size, shape and patterns within the crystals will vary.  Some Crystals are completely clear, and some have highly visible internal structures. We aim to be as consistent as possible in how we describe and represent them, and you will not be disappointed. If you are, we will make a full refund or replacement when the items are returned to us (see Returns).
  3. The 5p coin and ruler that you see beside most of the items are not included with the items. These are on the photo purely give you some idea of size.
  4. We try to describe and photograph items as accurately as possible to give you as much information as you need, and we use digital calipers to measure everything.
  5. You should also be aware that not all computer systems used for browsing the internet are of the same standard, and the resolution of each monitor will differ. Colour shades will vary depending on the technology that you are using to browse with. Video monitors can render colours differently from that of the original photography. We will include colour as part of our product description in order to clarify a colour, if we think it will help, but if you are in any doubt, please contact us, we are happy to answer your questions.
  6. There is no such thing as a "silly question" and we are all entitled to "senior moments" and "intellectual interludes"!

11. LIMIT OF LIABILITY

  1. Although the products sold on www.tribesandvibes.co.uk would be considered harmless by most people, we have no control over what you do with them or how you use them once you receive them. We therefore hereby specifically disclaim all liability for any loss, damage, injury or other negative consequence in whatever form, howsoever caused, which arises from the use (or indirect use) of any product advertised on, or supplied via the www.tribesandvibes.co.uk website.
  2. We have enjoyed the benefit of crystal healing, but any information on uses and properties included with the item description (which has been gathered from reputable sources, such as Judy Hall and Michael Gienger's books about crystal healing) do not, under any circumstances, constitute a claim on behalf of the TRIBES AND VIBES.
  3. The information given is not intended to act as a substitute for medical treatment, nor will any guarantees be given for any spiritual or metaphysical qualities.

12. By purchasing from this website you agree to be bound by these conditions of sale, and acknowledge that you have read and understood these conditions. If you are in any doubt about anything, we are more than happy to answer any questions you may have.
